There’s a website blatantly copying ours with the clear objective of confusing customers, as they sell many of the same products as us. They used to directly steal our content and images but now resort to imitating our design and style to such a degree that it’s evident they are ‘deriving’ their design from ours.
My complaint: - They have infringed copyright as defined under Sections 16, 17, and 20 of the CDPA 1988. - They risk consumer confusion, violating protections against passing off under common law and potentially breaching Section 10(3) of the Trade Marks Act. - They may infringe database rights if specific compilations of information, such as product descriptions, have been copied.
I have created a full document outlining all of these contraventions and require the assistance of a UK legal practice, appropriately registered, to send a cease-and-desist letter to the company and handle my complaint.
