I urgently require legal representation regarding my son, who has complex medical needs and is currently being kept in hospital without a court order.
We initially raised concerns about unexplained bruising on our child and escalated this to the hospital. Following this, we were asked to return for further tests, including bloodwork. We have consulted the dermatology department twice, where conflicting opinions suggested a potential medical cause. However, during our latest visit, the hospital stated that after review by their team, they do not believe the bruises are medically caused. Despite this, they have not confirmed any cause and have not determined that the parents or carers are responsible.
As a precaution, the hospital has refused to discharge our son and has indicated that if we attempt to take him home, they may involve the police. There is no court order, no child protection plan in place, and no formal accusations against us. They have mentioned holding a strategy meeting, but we have not been provided with a date, clear purpose, or any details of the process or potential outcomes.
Key concerns that require urgent legal action:
Our child is highly vulnerable and at risk of contracting respiratory illnesses by remaining in the hospital unnecessarily.
The hospital has no conclusive medical evidence linking the bruises to parental or caregiver actions.
Given our child’s medical needs, bruising could be caused by handling (lifting, hoisting, shower chair use, etc.), medical equipment, or an undiagnosed medical condition.
Keeping our son in hospital without legal grounds violates our parental rights and is not in his best interest.
There is no lawful basis for this detention, and there is no court order preventing his discharge.
